2. Definitions

 

In these Terms:

“Luke Storey Limited”, “we”, “us” or “our” means Luke Storey Limited.

 

“Client”, “you” or “your” means the person, business or organisation purchasing or enquiring about our services.

 

“Services” means any work provided by Luke Storey Limited, including marketing, media, photography, video, drone, website, SEO, social media, design, consultancy or related services.

 

“Deliverables” means the final agreed outputs provided to the Client, such as images, videos, websites, files, designs, reports, web pages, campaign assets, brochures or other materials.

 

“Quote” means the written price, proposal or estimate provided by Luke Storey Limited.

 

“Project” means the agreed work to be carried out for the Client.

 

3. Website use

 

This website is provided for general information about Luke Storey Limited and its services.

 

You agree not to:

 

  • misuse the website;

  • attempt to interfere with its security or operation;

  • copy or reproduce website content without permission;

  • submit false, misleading or unlawful information through website forms;

  • use the website in a way that may damage Luke Storey Limited or any third party.

 

We may update, change or remove website content at any time.

 

4. Enquiries and quotes

 

Submitting an enquiry through the website does not create a binding contract.

 

A contract is formed only when:

 

  • we have provided a written quote or proposal;

  • you have accepted it in writing, by email, form submission, payment, purchase order or other written confirmation; and

  • we have confirmed acceptance or commenced work.

 

Quotes are valid for 30 days unless stated otherwise.

 

Any quote is based on the information available at the time. If the scope, brief, location, timings, access requirements, deliverables or Client requirements change, we may revise the quote.

 

 

5. Scope of work

 

The scope of work will be set out in the quote, proposal, written email agreement or project brief.

 

Unless expressly included in writing, the following are not included:

 

  • copywriting;

  • paid advertising spend;

  • stock imagery, fonts, licences or third-party assets;

  • print costs;

  • hosting, domain, plugin or software subscription fees;

  • advanced SEO campaigns beyond agreed setup work;

  • ongoing website maintenance;

  • ongoing social media management;

  • additional revisions beyond those agreed;

  • travel outside the agreed area;

  • specialist permissions, licences, venue charges or access fees.

 

Any additional work requested by the Client may be quoted separately.

 

6. Client responsibilities

 

The Client agrees to provide:

 

  • clear instructions and accurate project information;

  • access to premises, staff, systems, websites, accounts or locations where required;

  • brand assets, logos, copy, images and existing materials where needed;

  • timely feedback and approvals;

  • any necessary property, site, building, landlord, occupier, tenant, neighbour or third-party permissions;

  • confirmation of any restrictions, safety issues, sensitivities or confidentiality requirements;

  • accurate legal, business and contact information.

 

Delays in providing required information, feedback, approvals, access or permissions may delay delivery timescales.

 

Luke Storey Limited is not responsible for delay, additional cost or reduced output caused by incomplete information, late feedback, restricted access or unavailable permissions.

 

7. Fees and payment

 

Fees will be set out in the quote, invoice or written agreement.

 

Unless otherwise agreed:

 

  • deposits are payable before work begins;

  • final balances are payable before release of final high-resolution files, completed website transfer, publication, launch or delivery of final assets;

  • invoices are payable within the payment terms stated on the invoice;

  • payments must be made in pounds sterling;

  • the Client is responsible for any bank, transfer or transaction charges.

  • For larger projects, staged payments may be required.

 

If payment is late, we reserve the right to:

 

  • pause work;

  • withhold deliverables;

  • remove or suspend access to draft work;

  • charge interest and recovery costs where permitted by law;

  • recover unpaid sums through debt recovery or legal action.

 

8. Deposits

 

Deposits secure time in the diary and cover preparation, planning and initial work.

 

Unless stated otherwise, deposits are non-refundable once work has started, preparation has been carried out, time has been allocated or third-party costs have been incurred.

 

If a Client cancels after paying a deposit, we may retain the deposit to cover time, administration, preparation, planning, lost availability and costs already incurred.

 

9. Cancellations and postponements

 

If you need to cancel or postpone a project, you must notify us as soon as possible in writing.

Where a booking, shoot, site visit or production day is cancelled or postponed by the Client, the following may apply unless otherwise agreed:

 

  • cancellation more than 48 hours before the booked date: deposit retained, balance not normally payable;

  • cancellation within 48 hours of the booked date: up to 50% of the agreed fee may be payable;

  • cancellation after travel, preparation, equipment hire, subcontractor booking or third-party costs have been incurred: those costs may be charged in full.

 

We will make reasonable efforts to reschedule where possible, but availability cannot be guaranteed.

 

10. Weather, access and operational delays

 

Some services depend on weather, daylight, access, safety, site conditions, permissions, third-party cooperation and operational feasibility.

 

This is particularly relevant to:

 

  • drone work;

  • exterior photography;

  • exterior video production;

  • property shoots;

  • 360° tours;

  • location-based filming;

  • site or roof-related media;

  • travel-dependent work.

 

If conditions are unsuitable, unsafe or impractical, we may postpone, reschedule, modify or cancel the affected work.

 

Luke Storey Limited is not responsible for weather, poor site conditions, restricted access, unsafe conditions, public interference, security refusal, road closures, airspace restrictions, venue rules or any factor outside our reasonable control.

 

11. Drone services

 

Where drone services are provided, flights will be planned and carried out in accordance with applicable UK drone laws, Civil Aviation Authority requirements, airspace restrictions, safety considerations and operational limitations.

 

Drone activity is subject to:

 

  • suitable weather conditions;

  • safe take-off and landing areas;

  • visual line of sight requirements;

  • site access and landowner permission;

  • airspace restrictions;

  • nearby people, vehicles, buildings and hazards;

  • privacy considerations;

  • aircraft performance and battery limitations;

  • risk assessment;

  • remote pilot judgement;

  • applicable CAA rules and guidance.

 

Luke Storey Limited may refuse, postpone or stop any drone operation where, in our professional judgement, it would be unsafe, unlawful, unsuitable, restricted or impractical.

 

Where drone work is carried out, it will be undertaken by a remote pilot holding an A2 Certificate of Competency (A2 CofC), subject to the qualification remaining valid at the time of the work and the operation falling within the applicable permitted operating category.

 

Where required, Luke Storey Limited will also maintain appropriate CAA registration, Flyer ID, Operator ID and third-party insurance for commercial drone operations.

 

The Client is responsible for securing all required site, landowner, occupier, landlord, tenant, managing agent, event organiser or property permissions unless otherwise agreed in writing.

 

The Client must notify Luke Storey Limited in advance of any known restrictions, including:

 

  • nearby airports, heliports or restricted airspace;

  • sensitive sites;

  • schools, prisons, emergency service sites or military sites;

  • public events or crowds;

  • railway, highway or infrastructure restrictions;

  • private estate or managing agent requirements;

  • building management rules;

  • privacy concerns;

  • livestock, animals or environmental sensitivities.

 

Drone deliverables are subject to what can lawfully and safely be captured on the day.

 

12. Photography and video production

 

Photography and video production will be carried out based on the agreed brief, available access, site conditions, lighting, weather, time available and practical limitations.

 

The Client is responsible for ensuring that:

 

  • locations are ready for the shoot;

  • spaces are clean, safe and accessible;

  • staff, models, presenters or participants are available where required;

  • any products, props, vehicles, signage or materials are prepared;

  • required permissions and releases are obtained;

  • confidential or sensitive material is removed or disclosed before filming.

 

We are not responsible for reduced output caused by poor preparation, unavailable subjects, restricted rooms, obstructed spaces, poor lighting, unsafe access, building works, tenant activity, parked vehicles, weather or third-party disruption.

 

13. People, models and permissions

 

If people appear in photography or video, the Client is responsible for ensuring that all required consents, releases and permissions have been obtained unless otherwise agreed in writing.

 

This includes employees, contractors, models, presenters, visitors, tenants, occupiers and members of the public where relevant.

 

Luke Storey Limited may ask for written confirmation that relevant permissions are in place.

 

14. Website design and development

 

Website services may include design, build, setup, content upload, basic SEO setup, mobile optimisation and related support, depending on the agreed scope.

 

Unless otherwise agreed, the Client is responsible for:

 

  • domain registration and ownership;

  • website hosting fees;

  • Wix subscription fees or other platform costs;

  • paid apps, plugins, integrations or third-party tools;

  • copy, legal pages and compliance wording;

  • privacy policy, cookie policy and terms;

  • ongoing updates and maintenance after completion;

  • ensuring website claims, credentials, pricing and business information are accurate.

 

We may provide guidance, structure and draft wording, but the Client remains responsible for the accuracy and legality of website content.

 

Once a website is approved, published or handed over, further changes may be charged separately unless covered by an agreed maintenance arrangement.

 

15. SEO / AEO services

 

SEO and AEO services may include technical setup, content structure, metadata, keyword guidance, on-page optimisation, local SEO, Google Business Profile support and related recommendations.

 

SEO and AEO services do not guarantee:

 

  • first-page rankings;

  • specific Google positions;

  • traffic volumes;

  • enquiry volumes;

  • sales;

  • AI overview inclusion;

  • search engine indexing within a specific timescale.

 

Search results are influenced by search engine algorithms, competitor activity, website history, content quality, backlinks, technical performance, market demand and other factors outside our control.

 

16. Social media services

 

Social media services may include content creation, post design, scheduling support, strategy, caption writing, platform setup or account management, depending on the agreed scope.

Unless otherwise agreed, the Client is responsible for:

 

  • account ownership;

  • platform access;

  • approval of posts before publication;

  • compliance with platform rules;

  • responding to comments, messages and enquiries;

  • legal accuracy of claims;

  • regulated or sensitive content approvals.

 

We do not guarantee follower growth, engagement, reach, enquiries or sales from social media activity.

 

17. Brochure and print design

 

Brochure, print and design services may include layout, design, formatting and preparation of files for digital or print use.

 

Unless otherwise agreed, printing costs are not included.

 

The Client is responsible for checking and approving:

 

  • spelling;

  • grammar;

  • contact details;

  • prices;

  • measurements;

  • specifications;

  • floor areas;

  • property details;

  • legal statements;

  • disclaimers;

  • imagery;

  • logos;

  • compliance wording.

 

Once artwork has been approved, Luke Storey Limited is not responsible for errors later identified in approved files.

 

18. Revisions and approvals

 

The number of included revisions will be stated in the quote or proposal.

 

If no number is stated, the project includes up to two reasonable rounds of revisions.

 

Revisions must be within the original agreed scope.

Additional revisions, major changes, change of direction, new deliverables, replacement copy, additional editing or reworking caused by changed instructions may be charged separately.

 

 

Approval may be given by email, message, form submission, written confirmation or publication instruction.

 

Once the Client has approved deliverables, further changes may be chargeable.

 

19. Delivery timescales

 

Any delivery dates or timescales are estimates unless expressly agreed as fixed deadlines in writing.

 

  • Delivery may be affected by:

  • late Client feedback;

  • delayed approvals;

  • incomplete information;

  • access restrictions;

  • weather;

  • third-party delays;

  • platform issues;

  • technical problems;

  • illness;

  • subcontractor availability;

  • events outside our reasonable control.

 

We will make reasonable efforts to meet agreed timescales, but we are not liable for delay caused by circumstances outside our reasonable control.

 

20. File delivery and storage

 

Final files may be delivered by email, download link, cloud storage, WeTransfer, shared folder, website upload or another agreed method.

 

The Client is responsible for downloading and safely storing final files.

 

Unless otherwise agreed, Luke Storey Limited is not required to store project files indefinitely.

We may delete raw files, working files, project files, drafts and exported files after a reasonable period.

 

Raw footage, raw images, project files, editing timelines, layered files and source files are not included unless expressly agreed in writing.

 

21. Intellectual property

 

Unless otherwise agreed in writing, Luke Storey Limited retains ownership of all copyright and intellectual property in original materials created by us until full payment has been received.

 

Once full payment has been received, the Client receives a licence to use the final agreed deliverables for their business marketing purposes.

 

This licence does not automatically include:

 

  • resale of the deliverables;

  • transfer to third parties;

  • use in paid advertising beyond the agreed scope;

  • editing, altering or reworking by third parties;

  • use of raw files or source files;

  • use outside the agreed project, brand, property, campaign or business;

  • exclusive ownership unless expressly agreed.

 

Full copyright assignment, exclusivity, raw files, extended usage or third-party usage rights must be agreed separately and may incur additional fees.

 

22. Client materials and third-party rights

 

The Client confirms that any materials supplied to Luke Storey Limited are owned by the Client or properly licensed.

 

This includes:

 

  • logos;

  • images;

  • videos;

  • fonts;

  • copy;

  • brand assets;

  • music;

  • data;

  • plans;

  • drawings;

  • property information;

  • third-party content.

 

The Client agrees to indemnify Luke Storey Limited against claims arising from materials supplied by the Client or used at the Client’s request.

 

23. Portfolio and promotional use

 

Unless the Client requests otherwise in writing before the project begins, Luke Storey Limited may use completed work for portfolio, website, social media, marketing, award submission, proposal and promotional purposes.

 

This may include images, video clips, screenshots, designs, project descriptions and behind-the-scenes material.

 

We will not intentionally disclose confidential information.

 

If a project is confidential, embargoed or commercially sensitive, the Client must confirm this in writing before work begins.

 

24. Confidentiality

 

Each party agrees to keep confidential information private and not disclose it except where necessary to perform the services, comply with law or obtain professional advice.

 

Confidential information does not include information that is already public, independently developed or lawfully obtained from another source.

 

25. Subcontractors and third-party suppliers

 

Luke Storey Limited may use trusted subcontractors, freelancers, assistants or third-party suppliers where reasonably required to deliver the services.

 

This may include editors, designers, developers, photographers, videographers, drone operators, copywriters, printers or specialist providers.

 

We remain responsible for managing the overall project unless otherwise agreed.

 

26. Third-party platforms

 

Some services may involve third-party platforms, including but not limited to Wix, Google, Meta, LinkedIn, Instagram, YouTube, TikTok, email platforms, cloud storage providers, analytics tools, domain registrars and hosting providers.

 

Luke Storey Limited is not responsible for:

 

  • outages;

  • account restrictions;

  • platform changes;

  • algorithm changes;

  • rejected ads or posts;

  • loss of access;

  • changes to pricing;

  • third-party security incidents;

  • loss of data caused by third-party systems;

  • changes to third-party terms or functionality.

 

The Client remains responsible for complying with third-party platform terms.

 

27. Accuracy of information

 

The Client is responsible for ensuring all information supplied to Luke Storey Limited is accurate, lawful and not misleading.

 

This includes:

 

  • property details;

  • business claims;

  • prices;

  • measurements;

  • specifications;

  • qualifications;

  • testimonials;

  • case studies;

  • addresses;

  • contact details;

  • legal statements;

  • regulatory wording.

 

We may query information where appropriate, but we are not responsible for verifying all Client-supplied information unless expressly agreed.

 

28. Limitation of liability

 

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

Subject to that, Luke Storey Limited is not liable for:

 

  • loss of profits;

  • loss of revenue;

  • loss of business;

  • loss of goodwill;

  • loss of anticipated savings;

  • loss of opportunity;

  • indirect or consequential loss;

  • platform outages;

  • search ranking changes;

  • social media performance changes;

  • delays outside our control;

  • Client-supplied errors;

  • third-party claims caused by Client materials or instructions.

 

Our total liability for any claim arising from a project shall not exceed the amount paid by the Client for the specific project giving rise to the claim, unless otherwise required by law.

 

29. Force majeure

 

Luke Storey Limited is not liable for delay or failure to perform caused by events outside our reasonable control.

 

This includes but is not limited to:

 

  • severe weather;

  • illness;

  • accidents;

  • transport disruption;

  • equipment failure;

  • internet or power failure;

  • cyber incidents;

  • war, terrorism or civil unrest;

  • government restrictions;

  • airspace restrictions;

  • natural disasters;

  • strikes;

  • supplier failure;

  • platform outages;

  • legal or regulatory changes.

 

30. Complaints

 

If you are unhappy with any aspect of the services, you must contact us in writing as soon as possible.

 

We will review the issue and make reasonable efforts to resolve it.

The Client must give Luke Storey Limited a reasonable opportunity to put things right before seeking third-party remedies, chargebacks, public complaints or legal action.

 

31. Consumer clients

 

Most Luke Storey Limited services are provided to businesses, property companies, landlords, agents, consultants and commercial clients.

 

If you are a consumer purchasing services for personal use, you may have additional legal rights.

Where consumer cancellation rights apply, these will be handled in accordance with applicable consumer law.

 

If you request that services begin within any applicable cancellation period, you may be required to pay for work carried out before cancellation.

 

Where digital content, downloads or completed deliverables are supplied, your cancellation rights may be affected once work has started, files are delivered or the service has been completed, where permitted by law.

 

32. Termination

 

Either party may terminate a project by written notice if the other party materially breaches these Terms and fails to remedy the breach within a reasonable period.

 

Luke Storey Limited may terminate or pause work immediately if:

 

  • payment is overdue;

  • the Client is abusive, threatening or unreasonable;

  • the Client requests unlawful, unsafe or unethical work;

  • required permissions are not in place;

  • the project becomes unsafe or impractical;

  • the Client materially changes the scope;

  • the Client fails to provide required information or approvals.

 

On termination, the Client must pay for all work completed, time spent, expenses incurred and third-party costs committed up to the termination date.

 

33. Changes to these Terms

 

We may update these Terms and Conditions from time to time.

 

The latest version will be published on this website.

 

The Terms that apply to a project will usually be the Terms in place when the quote is accepted, unless otherwise agreed.

 

34. Governing law and jurisdiction

 

These Terms and any dispute arising from them are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction, unless applicable law requires otherwise.
